📄 Terms of Service

📋 1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Student", "you") and Jain Developers LMS ("Company", "we", "us", "our") governing your access to and use of the learning management system available at jain.dev and all related applications and services (collectively, the "Platform").

By creating an account, clicking "I agree", or otherwise using the Platform, you confirm that:

• You are at least 13 years of age (or have parental/guardian consent)
• You have read, understood, and agree to be bound by these Terms
• You agree to our Privacy Policy which is incorporated into these Terms by reference
• If using the Platform on behalf of an organisation, you have authority to bind that organisation

👤 2. User Accounts

Registration

To access most features, you must register for an account using a valid email address and a secure password. You may also register via Google or GitHub OAuth. You agree to provide accurate, current, and complete information during registration.

Account Responsibility

• You are solely responsible for maintaining the confidentiality of your login credentials
• You must not share your account with others or allow others to access the Platform using your credentials
• You are responsible for all activity that occurs under your account
• Notify us immediately at jaindevelopersfdk@gmail.com if you suspect unauthorised access to your account

Account Accuracy

You agree to keep your profile information accurate and up-to-date. Providing false information, including using someone else's name or email, may result in immediate account termination.

✅ 3. Permitted Use

Allowed Uses

• Accessing courses, lessons, and learning materials for your personal educational development
• Completing assignments, quizzes, and projects as part of enrolled courses
• Using AI features for educational purposes related to the Platform's content
• Participating in community forums and discussion boards in a respectful manner
• Downloading resources explicitly made available for download by instructors

Prohibited Uses

• Cheating & Academic Dishonesty: Submitting others' work as your own, sharing quiz answers, or using unauthorised assistance on assessments
• Content Scraping: Automated downloading, scraping, or bulk copying of course content, videos, or materials
• Reverse Engineering: Attempting to decompile, reverse engineer, or extract source code from the Platform
• Circumventing Access Controls: Attempting to access content, features, or user data beyond your authorised level
• Commercial Redistribution: Selling, sublicensing, or redistributing course content to third parties
• Harassment: Harassing, threatening, or abusing other users or staff members
• Malicious Activity: Uploading malware, attempting SQL injection, or any form of cyberattack on the Platform
• Spam: Sending unsolicited messages or posting irrelevant content in community spaces

📝 4. User-Generated Content

The Platform allows users to submit content including forum posts, notes, assignment submissions, and code. By submitting content, you:

• Grant Jain Developers a non-exclusive, royalty-free licence to use, display, and distribute your submitted content within the Platform
• Represent that you own or have the right to submit the content
• Agree not to submit content that is illegal, defamatory, infringing, or otherwise harmful

We reserve the right to remove any user-generated content that violates these Terms at any time, without notice.

©️ 5. Intellectual Property

All content on the Platform — including but not limited to course videos, written materials, code samples, assessments, branding, and software — is the exclusive intellectual property of Jain Developers LMS or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

Your subscription or course enrollment grants you a personal, non-exclusive, non-transferable, revocable licence to access and use the content solely for your personal educational purposes.

The Jain Developers name, logo, and all related marks are trademarks of the Company. You may not use our trademarks without prior written consent.

💳 6. Payments & Refund Policy

Pricing

Pricing for Pro and Placement plans is displayed on our pricing page and is subject to change with 30 days' notice to existing subscribers. Prices are in Indian Rupees (INR) and include applicable taxes.

Payment Processing

Payments are processed securely by Razorpay or Stripe. By providing payment information, you authorise us to charge the applicable fees. We do not store complete card numbers on our servers.

Refund Policy

• Pro Plan: Full refund within 7 days of initial subscription, no questions asked. No refunds after 7 days.
• Placement Plan: Refund available if you complete all program milestones (lessons, assignments, mock interviews) and do not receive at least 3 interview opportunities within 6 months of program completion. Proof of completion required.
• One-time Course Purchases: Refund within 7 days if less than 20% of the course content has been accessed.

Refund requests must be submitted via the Contact Us page. Approved refunds are processed within 5–7 business days to the original payment method.

🎯 7. Placement Guarantee Terms

The Placement plan includes a conditional guarantee subject to the following requirements:

1. Complete 100% of all course lessons in the placement curriculum
2. Submit all assignments and receive a passing grade on each
3. Complete a minimum of 5 mock interview sessions with our AI or mentors
4. Create and submit your resume and portfolio for review
5. Actively apply to job opportunities referred through our platform
6. Complete the above within the 6-month program window

Students who complete all requirements but do not receive 3 interview opportunities within 6 months are eligible for a full refund of the Placement plan fee.

🤖 8. AI Features

The Platform includes AI-powered features including the AI Doubt Solver, AI Quiz Generator, and AI Resume Analyzer, powered by third-party AI providers including Anthropic's Claude API.

• AI features are provided "as-is" and their outputs are not guaranteed to be accurate, complete, or suitable for any specific purpose
• Do not share sensitive personal information (passwords, financial data, government IDs) with the AI assistant
• AI-generated content should be reviewed critically and not relied upon as professional legal, medical, financial, or other advice
• The use of AI features to complete assessments you are expected to complete yourself constitutes academic dishonesty and violates Section 3
• We reserve the right to modify, limit, or remove AI features at any time

🚫 9. Termination

By You

You may deactivate your account at any time by going to Profile Settings → Delete Account. Upon deletion, your personal data will be handled as described in our Privacy Policy.

By Us

We reserve the right to suspend or permanently terminate your account, without prior notice, if:

• You violate any provision of these Terms
• You engage in fraudulent, harmful, or illegal activity
• Your account is used for commercial purposes not authorised by us
• Continued operation of your account poses a risk to other users or the Platform

Upon termination, your right to access the Platform immediately ceases. We are not liable to you or any third party for any such termination.

⚠️ 10. Disclaimers

The Platform and all content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Platform will be uninterrupted, error-free, or completely secure
• Completing any course guarantees employment or any specific career outcome
• The information provided in courses is fully up-to-date or accurate at all times
• AI-generated responses are correct, complete, or appropriate for your specific situation

🛡️ 11. Limitation of Liability

To the maximum extent permitted by applicable law, Jain Developers LMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of data, or loss of goodwill, arising from your use of or inability to use the Platform.

Our total aggregate liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by applicable law.

⚖️ 12. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any dispute, claim, or controversy arising from or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

📝 13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Send an email notification to registered users at least 14 days before changes take effect
• Display a prominent banner on the Platform

Continued use of the Platform after the effective date of changes constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform and may request account deletion.
